Terms and Conditions & Event Participation Agreement

Welcome to Dog Social Events trading as Dog Social (“Dog Social”). Dog Social is a dog-focused social events platform premised on creating safe, structured, and dog-first environments for positive social interaction between dogs and the humans who attend with them. Dog Social organises and delivers ticketed events hosted at third-party venues, where dogs (“Dogs”) and human attendees (“Attendees”) may participate in social, recreational, and activation-based experiences.

This Terms and Conditions and Event Participation Agreement (this “Agreement”) sets forth the terms, conditions, rules, policies, and requirements governing the purchase and use of tickets, attendance at Dog Social events, participation in any activities offered at such events, and access to Dog Social’s website and related services.

BY ACCESSING OR USING THE DOG SOCIAL WEBSITE (“SITE”), PURCHASING OR HOLDING A TICKET, COMPLETING ANY REGISTRATION PROCESS, CLICKING “I ACCEPT” OR SIMILAR ACKNOWLEDGEMENT, SIGNING ANY WAIVER, AND/OR ATTENDING, OBSERVING, OR PARTICIPATING IN ANY DOG SOCIAL EVENT HOSTED AT A THIRD-PARTY VENUE (EACH, AN “EVENT”), INCLUDING ANY ACTIVATION AREAS, SOCIAL AREAS, ENTRY POINTS, OR OTHER SPACES MADE AVAILABLE IN CONNECTION WITH SUCH EVENT (COLLECTIVELY, THE “SERVICES”), YOU REPRESENT AND WARRANT THAT:

(1) YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THIS AGREEMENT;

(2) YOU ARE OF LEGAL AGE AND HAVE LEGAL CAPACITY TO ENTER INTO A BINDING CONTRACT WITH DOG SOCIAL; AND

(3) YOU HAVE THE AUTHORITY TO ENTER INTO THIS AGREEMENT PERSONALLY AND, WHERE APPLICABLE, ON BEHALF OF ANY DOG YOU BRING TO AN EVENT.

THE TERM “YOU” REFERS TO THE INDIVIDUAL ACCESSING THE SITE, PURCHASING OR USING A TICKET, OR ATTENDING AN EVENT. IF YOU DO NOT AGREE TO BE BOUND BY THIS AGREEMENT, YOU MUST NOT ACCESS THE SITE, PURCHASE OR USE A TICKET, OR ATTEND ANY DOG SOCIAL EVENT.

IMPORTANT INFORMATION ABOUT ARBITRATION, CONSENTS, AND UPDATES TO THIS AGREEMENT

PLEASE BE AWARE THAT THIS AGREEMENT CONTAINS PROVISIONS GOVERNING HOW DISPUTES BETWEEN YOU AND DOG SOCIAL WILL BE RESOLVED. WITHOUT LIMITATION, THIS AGREEMENT INCLUDES A BINDING ARBITRATION REQUIREMENT AND A WAIVER OF YOUR RIGHT TO BRING OR PARTICIPATE IN CLASS ACTIONS OR REPRESENTATIVE PROCEEDINGS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THIS AGREEMENT, YOUR USE OF THE SITE, YOUR PURCHASE OR USE OF A TICKET, OR YOUR ATTENDANCE AT OR PARTICIPATION IN ANY EVENT SHALL BE RESOLVED BY FINAL AND BINDING ARBITRATION ON AN INDIVIDUAL BASIS. YOU AND DOG SOCIAL EACH WAIVE ANY RIGHT TO A JURY TRIAL AND ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS-WIDE ARBITRATION, OR REPRESENTATIVE PROCEEDING.

IMPORTANT INFORMATION ABOUT WEBSITE TERMS AND SUPPLEMENTAL TERMS

Your access to and use of the Site, and your online activities related thereto, are also subject to Dog Social’s Website Terms of Use. In the event of a conflict between this Agreement and the Website Terms of Use, this Agreement shall govern to the extent of the conflict.

In addition, certain Services or aspects of Events may be subject to additional terms, conditions, rules, or policies (“Supplemental Terms”), which may be posted on the Site, displayed at an Event, provided during ticket purchase or registration, or presented to you for acceptance in connection with a specific Service. If this Agreement is inconsistent with any applicable Supplemental Terms, the Supplemental Terms shall control with respect to that specific Service or Event.

This Agreement, together with the Website Terms of Use and any applicable Supplemental Terms, are collectively referred to herein as the “Agreement.”

DEFINITIONS AND INTERPRETATION

For purposes of this Agreement, the following capitalised terms shall have the meanings set forth below. Capitalised terms used in this Agreement that are not otherwise defined shall have their plain and ordinary meaning, as determined in the context of this Agreement. Words denoting the singular shall include the plural and vice versa, and words denoting any gender shall include all genders, unless the context clearly requires otherwise. Headings are included for convenience only and shall not affect the interpretation of this Agreement.

“Agreement” means this Terms and Conditions and Event Participation Agreement, together with any Website Terms of Use, Supplemental Terms, waivers, rules, policies, signage, notices, or other written or electronic terms referenced herein or made available by Dog Social Events, as the same may be amended from time to time.

“Attendee” means any dog participating in, present at, or otherwise attending a Dog Social Event, whether actively participating or passively present, and includes any dog brought onto or into an Event space, venue, activation area, entry point, or surrounding area in connection with an Event.

“Dog” means an Attendee and refers to any canine brought to an Event by a Human, regardless of breed, size, age, or purpose, and regardless of whether such Dog is owned, fostered, temporarily cared for, or otherwise under the supervision or control of a Human.

“Human” means the individual or individuals who purchase or hold a ticket, access the Site, execute a waiver, or attend an Event and who are the legal owner, authorised handler, guardian, or person otherwise responsible for the supervision, safety, control, conduct, and care of an Attendee. The Human is solely responsible for the actions and omissions of the Attendee at all times.

“Event” means any ticketed Dog Social gathering, activation, session, experience, or activity organised, hosted, sponsored, or facilitated by Dog Social Events, whether held indoors or outdoors, and including without limitation all associated areas such as entry points, queuing areas, play areas, social zones, activation spaces, food and beverage areas, pathways, and any surrounding areas designated for Event use.

“Services” means collectively the Site, Events, ticketing services, registration processes, communications, digital platforms, and any other services, features, or offerings made available by Dog Social Events, whether online, in-person, or otherwise.

“Site” means the Dog Social website located at https://dogsocial.co and any related subdomains, mobile versions, or digital platforms operated by or on behalf of Dog Social Events.

“Dog Social Events,” “Dog Social,” “we,” “us,” or “our” means Dog Social Events trading as Dog Social (ABN 97 246 949 793), including its owners, officers, employees, contractors, representatives, agents, and affiliates.

“Venue Partner” means any third-party venue owner, operator, landlord, licensee, occupier, service provider, sponsor, or other third party that owns, controls, manages, licenses, or provides access to any premises, land, facilities, or infrastructure used in connection with an Event.

“Pawfessionals” means Dog Social Events’ employees, contractors, canine professionals, monitors, safety personnel, volunteers, or representatives present at an Event for the purposes of observation, guidance, intervention, or event management, and who do not assume responsibility for any Attendee.

“Ticket” means a valid ticket issued or authorised by Dog Social Events permitting attendance at a specific Event, subject to the terms of this Agreement.

“Documentation” means any records, certificates, waivers, acknowledgements, forms, or information required by Dog Social Events, including without limitation vaccination records, desexing certificates, liability waivers, identification, or other materials reasonably required for safety, compliance, or participation.

“Supplemental Terms” means any additional terms, conditions, rules, policies, or notices applicable to specific Services or Events, including those posted on the Site, displayed at an Event, communicated electronically, or presented for acceptance during registration or ticket purchase.

“Recordings” means any photographs, video recordings, audio recordings, audiovisual works, images, likenesses, voices, or other recordings captured at or in connection with an Event, whether captured intentionally or incidentally, by or on behalf of Dog Social Events or its designees.

“Dog Social Materials” means any materials created by or on behalf of Dog Social Events incorporating Recordings, including without limitation promotional materials, advertising materials, marketing content, social media content, digital content, print content, or other commercial or non-commercial works.

Interpretation

This Agreement shall be interpreted and enforced in accordance with the laws of Queensland, Australia, without regard to conflict-of-laws principles. References to “including” or “includes” shall be deemed to be followed by the words “without limitation.” Any ambiguity shall not be construed against the drafting party.

SCOPE OF SERVICES; NATURE OF EVENTS; NO GUARANTEE OF ACCESS OR AVAILABILITY

Dog Social Events organises, curates, and hosts ticketed, dog-focused social events at locations owned, operated, licensed, or otherwise controlled by third-party Venue Partners. Dog Social Events does not own, lease, manage, or control the premises at which Events are held and does not guarantee any particular venue, layout, configuration, surface condition, amenity, facility, activation, supervision level, staffing level, or experience.

The Services provided by Dog Social Events include, without limitation, the organisation and administration of Events, ticketing and registration services, the provision of access to designated Event areas, the coordination of Pawfessionals for observation and event support, and the facilitation of social environments intended to promote positive interaction between Attendees and Humans. Dog Social Events does not provide training services, behaviour modification services, veterinary services, boarding services, supervision services, or guarantees regarding the conduct, temperament, safety, compatibility, or outcomes of any Attendee or Human.

Access to Events is subject to capacity limits, safety considerations, venue restrictions, regulatory requirements, weather conditions, environmental factors, and the sole and absolute discretion of Dog Social Events. Dog Social Events reserves the unrestricted right to deny, restrict, suspend, or revoke access to any Event, area within an Event, or Service at any time, with or without notice, where Dog Social Events determines, in its sole judgment, that such action is necessary or appropriate for safety, compliance, operational integrity, crowd management, behavioural management, venue requirements, or Event continuity.

Dog Social Events further reserves the right, at any time and without obligation to provide notice or compensation, to modify, alter, substitute, suspend, delay, reschedule, shorten, extend, relocate, or cancel any Event, activation, activity, feature, layout, timetable, rule, requirement, or aspect of the Services. Such modifications may include, without limitation, changes to Event dates, times, duration, capacity, zoning, play areas, social areas, entry procedures, documentation requirements, supervision presence, Pawfessional deployment, and participation rules.

Dog Social Events makes no representations, warranties, or guarantees, express or implied, regarding the availability, quality, suitability, safety, or outcomes of any Event or Service, or that any Event will meet any particular expectation, preference, or purpose of any Human or Attendee. Attendance at and participation in Events is entirely voluntary and undertaken at the sole risk of the Human and Attendee, subject to the terms of this Agreement.

Nothing in this section, or elsewhere in this Agreement, shall be construed as creating any obligation on the part of Dog Social Events to provide continued access to any Event or Service, to maintain any particular format or offering, or to continue offering Events at any specific location or venue.

WEBSITE TERMS OF USE; SUPPLEMENTAL TERMS; ORDER OF PRECEDENCE

Your access to and use of the Site, and any online activities related thereto, are subject to this Agreement as well as Dog Social’s Website Terms of Use. In the event of any conflict or inconsistency between this Agreement and the Website Terms of Use, this Agreement shall govern to the extent of such conflict.

In addition, your access to and participation in certain Services or Events may be subject to additional terms, conditions, rules, policies, guidelines, requirements, notices, or instructions (collectively, “Supplemental Terms”). Supplemental Terms may be communicated or made available in a variety of ways, including without limitation through postings on the Site, during the ticket purchase or registration process, within confirmation emails or other electronic communications, on printed materials, via on-site signage, through announcements, or through verbal or written instructions provided by Dog Social Events, Pawfessionals, venue staff, or Venue Partners before or during an Event.

You acknowledge and agree that all Supplemental Terms are hereby incorporated into and form part of this Agreement as if fully set forth herein. Compliance with all applicable Supplemental Terms is a condition of your access to and continued participation in the Services and Events. Failure to comply with any Supplemental Term may result in restriction of access, removal from an Event, termination of your Ticket, suspension from future Events, or other enforcement action, in each case without refund.

To the maximum extent permitted by law, in the event of any conflict or inconsistency between this Agreement and any Supplemental Terms applicable to a specific Service or Event, the Supplemental Terms shall control with respect to that Service or Event. In the event of any conflict or inconsistency among multiple Supplemental Terms, Dog Social Events shall determine, in its sole and absolute discretion, which terms shall apply.

You further acknowledge and agree that Dog Social Events may amend, supplement, replace, or update any Supplemental Terms at any time, including during an Event, where reasonably necessary for safety, compliance, operational integrity, or Event continuity. Continued attendance at or participation in an Event following notice of any such amendment constitutes your acceptance of the amended or new Supplemental Terms.

TICKETS; FEES; PAYMENTS; NO REFUNDS; NO TRANSFERS

Access to Events is permitted only through the purchase or authorised possession of a valid Ticket issued by Dog Social Events. Tickets are issued on a limited, revocable, non-exclusive basis and confer a conditional right of entry and participation, subject at all times to this Agreement and any applicable Supplemental Terms.

All fees associated with Tickets, including ticket prices, booking fees, service fees, processing fees, and any other charges, are payable in full at the time of purchase unless expressly stated otherwise in writing by Dog Social Events. You represent and warrant that all payment information provided in connection with any Ticket purchase is current, accurate, complete, and authorised, and you authorise Dog Social Events and its third-party payment processors to charge the applicable fees to your selected payment method.

All Ticket sales are final. To the maximum extent permitted by law, Tickets are non-refundable, non-transferable, and may not be resold, assigned, exchanged, shared, or modified for any reason whatsoever. You expressly waive any right to a refund or credit arising from or related to change of mind, illness, injury, personal circumstances, scheduling conflicts, travel disruptions, dissatisfaction with an Event, behavioural restriction or removal, refusal of entry, weather conditions, venue conditions, failure to provide required documentation, or failure to attend for any reason.

Dog Social Events reserves the right, in its sole and absolute discretion, to cancel, invalidate, or refuse to honour any Ticket that it reasonably believes has been obtained, used, or transferred in violation of this Agreement or any applicable Supplemental Terms. Any such cancellation or invalidation may occur without refund.

If an Event is cancelled or postponed due to circumstances beyond the reasonable control of Dog Social Events or its Venue Partners, including without limitation acts of God, severe weather, safety concerns, government directives, regulatory restrictions, or venue-related issues, Dog Social Events may, but is not obligated to, reschedule the Event. Where a cancellation or postponement extends beyond three (3) months from the originally scheduled Event date, Dog Social Events may, in its sole discretion, offer a refund or credit. No refund or credit is guaranteed, and Dog Social Events’ determination shall be final.

Nothing in this section is intended to exclude, restrict, or modify any rights or remedies available under the Australian Consumer Law that cannot lawfully be excluded or limited.

ELIGIBILITY; DOCUMENTATION; CONDITIONS OF ENTRY

Attendance at and participation in any Event is conditional upon strict compliance with this Agreement, all applicable Supplemental Terms, and all eligibility, documentation, and entry requirements established by Dog Social Events. Possession of a Ticket does not guarantee entry or participation and may be revoked at any time in accordance with this Agreement.

Each Dog attending an Event must meet all eligibility requirements established by Dog Social Events, including without limitation requirements relating to health, vaccination status, desexing status, behaviour, and suitability for participation in a group, off-leash social environment. Dog Social Events reserves the right to require proof of current vaccination, proof of desexing, veterinary records, behavioural disclosures, or other Documentation prior to an Event or at the point of entry.

All Humans attending an Event, whether or not accompanied by a Dog, are required to execute a Dog Social Events liability waiver in the form prescribed by Dog Social Events as a condition of entry and participation. Failure or refusal to complete any required waiver or Documentation may result in delayed entry, restricted access, or refusal of entry without refund.

Where Events are held at venues that serve or permit the consumption of alcohol, Humans may be required to present valid government-issued photographic identification in accordance with venue licensing requirements. Dog Social Events reserves the right to deny or restrict access to any Human who fails to comply with identification or venue requirements.

Dog Social Events may, in its sole and absolute discretion, delay, restrict, condition, or refuse entry to any Event, or to any area within an Event, where required Documentation is incomplete, unavailable, inaccurate, or unsatisfactory, or where Dog Social Events determines that entry would present a risk to safety, compliance, Event continuity, or the enjoyment of others. Any such determination may be made at any time, including after entry has been granted, and may be enforced without refund.

Eligibility and Documentation requirements are ongoing obligations. Compliance at one Event does not guarantee eligibility or entry at any subsequent Event.

REPRESENTATIONS, WARRANTIES, AND CONTINUING OBLIGATIONS

By purchasing a Ticket, executing any waiver, accessing the Site, or attending or participating in any Event, each Human represents, warrants, acknowledges, and agrees, on an ongoing basis, that: (i) the Human is the lawful owner of the Attendee or otherwise has full legal authority and consent to bring the Attendee to the Event; (ii) the Human accepts full responsibility for the supervision, control, conduct, safety, welfare, and care of the Attendee at all times while attending or participating in an Event; and (iii) the Human has the legal capacity and authority to enter into this Agreement and to bind themselves and, where applicable, the Attendee to its terms.

Each Human further represents and warrants that each Attendee brought to an Event is in good health, free from contagious illness or disease, has received all vaccinations required by Dog Social Events, is desexed unless expressly exempted in writing by Dog Social Events, and is suitable for participation in a group, off-leash social environment. Each Human represents and warrants that the Attendee does not have a known history of aggressive behaviour toward people or other dogs and has not exhibited behaviour that would make participation in an Event unsafe or inappropriate.

Each Human further represents and warrants that they will conduct themselves in a safe, responsible, respectful, and orderly manner at all times while attending or participating in an Event. Dog Social Events operates a zero-tolerance policy in respect of conduct that compromises safety, welfare, or Event continuity. Without limitation, each Human represents and warrants that they will not attend or participate in an Event while intoxicated, impaired, or otherwise under the influence of alcohol, drugs, or substances to a degree that may compromise judgment, supervision of an Attendee, compliance with this Agreement, venue rules, or instructions issued by Dog Social Events, Pawfessionals, venue staff, or Venue Partners.

Each Human further represents and warrants that they will not engage in any disorderly, aggressive, abusive, threatening, coercive, neglectful, harassing, or otherwise inappropriate behaviour toward any Attendee, any other attendee, any Pawfessional, any Dog Social Events staff member, any Venue Partner, or any venue staff. This includes, without limitation, conduct that places an Attendee at risk, demonstrates neglect, inappropriate handling, or failure to intervene where intervention is reasonably required.

Each Human acknowledges and agrees that Dog Social Events maintains a zero-tolerance approach to behaviour that, in Dog Social Events’ sole and absolute discretion, endangers or materially risks the safety, welfare, or wellbeing of any Attendee, person, or the Event environment. Any such conduct may result in immediate removal from the Event, termination of the Ticket, suspension from future Events, and enforcement action without refund.

Each Human further acknowledges and agrees that where Dog Social Events reasonably believes that the safety, welfare, or wellbeing of an Attendee is compromised, or that conduct may constitute neglect, mistreatment, or a breach of applicable animal welfare laws or regulations, Dog Social Events expressly reserves and exercises its full rights under law to document such concerns and to report, escalate, or refer the matter to relevant authorities, including without limitation animal welfare services, regulatory bodies, venue operators, or enforcement agencies, without notice to the Human and without liability to Dog Social Events.

Each Human represents and warrants that all information provided to Dog Social Events, whether during ticket purchase, registration, documentation submission, waiver execution, or otherwise, is true, accurate, complete, and not misleading. Each Human acknowledges that Dog Social Events relies on the accuracy of such information in permitting entry and participation and that any omission, misrepresentation, or inaccuracy may result in immediate removal from an Event, termination of the Ticket, suspension from future Events, or other enforcement action without refund.

The representations and warranties set forth in this section are continuing in nature and apply at all times during an Event and with respect to each Event attended. Compliance with eligibility or conduct requirements at one Event does not constitute a waiver of such requirements at any subsequent Event. Each Human has an ongoing obligation to immediately notify Dog Social Events of any change in circumstances that may affect an Attendee’s eligibility, health, behaviour, welfare, or suitability for participation.

Dog Social Events reserves the right, in its sole and absolute discretion, to investigate any suspected breach of this section and to take any action it deems appropriate, including without limitation restriction of participation, removal from an Event, termination of a Ticket, suspension from future Events, and referral to Venue Partners or relevant authorities, in each case without refund.

BEHAVIOUR RULES; ATTENDEE CONDUCT; HUMAN CONDUCT; ROLE OF PAWFESSIONALS; ZONING

Attendance at and participation in any Event is expressly conditioned upon continuous compliance with the behavioural standards set forth in this Agreement and any applicable Supplemental Terms. Dog Social Events operates behaviour-based participation standards designed to promote safety, welfare, and the peaceful enjoyment of Events for all Attendees and Humans. Possession of a Ticket does not create any entitlement to participate irrespective of behaviour.

Each Human acknowledges and agrees that Attendees are animals with inherent unpredictability and that behaviour may be influenced by environmental factors, including without limitation crowd density, noise, weather, mixed group dynamics, unfamiliar dogs or people, and Event layout. Each Human is solely responsible for monitoring their Attendee’s behaviour at all times and for intervening promptly where intervention is reasonably required.

Dog Social Events may, but does not guarantee that it will, to the best of its ability and subject to operational, spatial, safety, and venue constraints, implement zoning structures intended to support safe and compatible interaction among Attendees. Such zoning may include, without limitation, temperament-based zoning, Attendee sizing zoning, breed-based zoning, play-style or type-based zoning, general access zoning, mixed-play zoning, off-leash zoning, transitional or cooling-off zones, and any other zoning structures deemed appropriate by Dog Social Events based on circumstances that arise before or during an Event.

Each Human expressly acknowledges and agrees that entry of an Attendee into any zone is undertaken at the Human’s sole risk and discretion, and that zoning does not constitute a guarantee of compatibility, safety, or behaviour of any Attendee or Human. Zoning is provided, where available, as a risk-management and enjoyment-support measure only and does not replace the Human’s responsibility for supervision and control.

Arrival, Departure, and Public Spaces. Unless expressly permitted or signalled otherwise by Dog Social Events, Pawfessionals, venue staff, signage, or applicable Supplemental Terms, all Attendees must be tethered, leashed, or otherwise physically restrained at all times during arrival to an Event, departure from an Event, and while present in any public, transitional, queuing, entry, exit, car park, pathway, or non-designated Event area. Areas immediately outside Event grounds are subject to applicable local council laws and regulations, and compliance with such requirements is the sole responsibility of the Human.

Role and Limitations of Pawfessionals. Pawfessionals may be present at Events to observe Attendee behaviour, group dynamics, and environmental conditions and to support overall Event balance and safety. Pawfessionals do not manage Attendees on behalf of Humans, do not assume custody or control of any Attendee, and do not provide training, handling, behavioural correction, supervision, veterinary, or medical services.

Without limitation, Humans expressly acknowledge and agree that Pawfessionals do not pick up after Attendees and do not physically intervene in situations involving aggression, fights, altercations, or circumstances presenting an unnecessary or heightened risk of injury. Any observation, signalling, or direction provided by Pawfessionals does not create a duty to intervene or assume responsibility for outcomes.

Immediate Sanctions and Removal. Where Dog Social Events, in its sole and absolute discretion, determines that an Attendee or Human is involved in aggression, fighting, physical altercations, or conduct that presents a risk of injury or compromises Event safety or continuity, Dog Social Events may impose immediate sanctions, including removal from a zone or from the Event entirely. Such action may be taken swiftly, without warning, without explanation, and without regard to fault.

Where an incident involves interaction between two or more Attendees, all Attendees involved and their associated Humans may be sanctioned or removed, regardless of which party initiated or escalated the conduct. Enforcement action may be taken against one or all parties involved as deemed appropriate by Dog Social Events, acting in its sole and absolute discretion, and may be enforced without refund.

Injuries, Medical Care, and Veterinary Responsibility. Each Human expressly acknowledges and agrees that any injury, illness, harm, or damage sustained by an Attendee or Human during or in connection with aggression, altercations, fights, or behavioural incidents at an Event is not the responsibility of Dog Social Events. While Dog Social Events may, at its discretion, coordinate basic first aid response or facilitate emergency assistance where reasonably necessary, Dog Social Events does not provide medical or veterinary treatment and does not assume responsibility for diagnosis, treatment, transport, or ongoing care.

All medical treatment, veterinary care, emergency intervention, follow-up treatment, rehabilitation, and associated costs arising from any injury or incident are the sole responsibility and expense of the Human. Dog Social Events does not reimburse, cover, insure, or otherwise assume liability for any such costs or outcomes.

Dog Social Events reserves the right to contact emergency services, veterinary services, or relevant authorities where reasonably necessary for safety or welfare, without assuming any duty or liability in doing so.

Dog Social Events reserves the right to implement progressive or immediate interventions in response to behavioural concerns, including without limitation verbal direction, zoning reassignment, restriction of participation, or removal from the Event. No particular sequence of interventions is required, and Dog Social Events may escalate directly to removal where circumstances warrant.

All behavioural determinations, zoning decisions, Pawfessional limitations, interventions, sanctions, and enforcement actions taken by Dog Social Events are final, non-appealable, and made in the sole and absolute discretion of Dog Social Events, acting in the interests of safety, welfare, and the continuity and enjoyment of the Event.

INJURIES, MEDICAL CARE, AND VETERINARY RESPONSIBILITY.

EACH HUMAN EXPRESSLY ACKNOWLEDGES AND AGREES THAT ANY INJURY, ILLNESS, HARM, OR DAMAGE SUSTAINED BY AN ATTENDEE OR ANY HUMAN DURING OR IN CONNECTION WITH AGGRESSION, ALTERCATIONS, FIGHTS, OR BEHAVIOURAL INCIDENTS AT AN EVENT IS NOT THE RESPONSIBILITY OF DOG SOCIAL EVENTS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOG SOCIAL EVENTS DISCLAIMS ANY AND ALL RESPONSIBILITY, DUTY, OR LIABILITY FOR SUCH INJURIES OR OUTCOMES.

WHILE DOG SOCIAL EVENTS MAY, AT ITS SOLE DISCRETION, COORDINATE OR FACILITATE BASIC FIRST AID RESPONSE OR EMERGENCY ASSISTANCE WHERE REASONABLY NECESSARY, DOG SOCIAL EVENTS DOES NOT PROVIDE MEDICAL, VETERINARY, OR CLINICAL SERVICES AND DOES NOT ASSUME RESPONSIBILITY FOR DIAGNOSIS, TREATMENT, TRANSPORT, INTERVENTION, OR ONGOING CARE.

ALL MEDICAL TREATMENT, VETERINARY CARE, EMERGENCY INTERVENTION, FOLLOW-UP TREATMENT, REHABILITATION, AND ANY ASSOCIATED COSTS OR EXPENSES ARISING FROM ANY INJURY OR INCIDENT SHALL BE THE SOLE RESPONSIBILITY AND AT THE SOLE COST OF THE HUMAN. DOG SOCIAL EVENTS DOES NOT PAY, REIMBURSE, INSURE, ADVANCE, OR OTHERWISE ASSUME LIABILITY FOR ANY SUCH COSTS, LOSSES, OR OUTCOMES.

DOG SOCIAL EVENTS RESERVES THE RIGHT, BUT DOES NOT ASSUME ANY OBLIGATION, TO CONTACT EMERGENCY SERVICES, VETERINARY PROVIDERS, OR RELEVANT AUTHORITIES WHERE DOG SOCIAL EVENTS REASONABLY DETERMINES SUCH ACTION IS NECESSARY FOR SAFETY OR WELFARE. ANY SUCH ACTION SHALL NOT CREATE OR BE DEEMED TO CREATE ANY DUTY, ASSUMED RESPONSIBILITY, OR LIABILITY ON THE PART OF DOG SOCIAL EVENTS.

ENJOYMENT DEMERITS; INCIDENT DOCUMENTATION; REVIEW; SUSPENSION AND TERMINATION

Dog Social Events maintains an enjoyment demerits and incident review framework intended to support safety, welfare, and the continuity of Events. This framework is a risk-management and administrative mechanism only and does not constitute training, behavioural assessment, certification, or a guarantee of outcomes.

Each Attendee enters an Event subject to an initial allocation of behaviour standing determined by Dog Social Events. Where an incident, near-incident, or behavioural concern occurs, Dog Social Events may, in its sole and absolute discretion, document the circumstances, observations, and responses, including information provided by Pawfessionals, venue staff, or other relevant sources. Documentation may occur contemporaneously with the Event or following the Event and may include written notes, reports, photographs, video, or other materials.

Dog Social Events may, but is not obligated to, review documented incidents following an Event. Any review is conducted for internal safety, welfare, and operational purposes only. No review, documentation, or lack thereof creates any duty to an Attendee or Human, nor does it imply fault, negligence, or responsibility on the part of Dog Social Events.

Where Dog Social Events determines, in its sole and absolute discretion, that an Attendee has reached or exhausted its allocated behaviour standing, or that an incident is of sufficient seriousness to warrant immediate action irrespective of any prior standing, Dog Social Events may impose enforcement action. Enforcement action may include, without limitation, immediate removal from an Event, termination of the Ticket, temporary suspension from future Events, or longer-term or permanent exclusion.

Unless otherwise determined by Dog Social Events in its sole discretion, a suspension imposed under this section may be for a period of up to twelve (12) months from the date of the incident or enforcement action. Suspension periods, conditions, and eligibility for future participation are determined solely by Dog Social Events and may vary based on the nature of the incident, risk factors, compliance history, and safety considerations.

Post-Suspension Behavioural Clearance and Reintroduction. Where a suspension or termination is imposed as a result of behavioural concerns involving an Attendee, reinstatement following the conclusion of the suspension period is not automatic. As a condition of any consideration for future participation, Dog Social Events may require the Human to provide, at the Human’s sole cost and expense, a written reference, assessment, or clearance from a qualified behavioural veterinarian or another professional of equal or higher qualification and recognised standing within the relevant field, confirming that the Attendee has undergone appropriate assessment, intervention, or support.

Any reinstatement following a behavioural suspension, if permitted at all, shall be subject to Dog Social Events’ sole and absolute discretion and may include a gradual or conditional reintroduction process, participation limitations, zoning restrictions, additional requirements, or monitoring conditions as determined by Dog Social Events. Failure to comply with any reinstatement conditions may result in renewed suspension or termination without refund.

Dog Social Events may, but is not obligated to, provide notice of suspension, termination, or reinstatement conditions by electronic communication, including email, to the Human associated with the Attendee. Failure to receive or acknowledge such notice does not affect the validity or enforceability of any suspension, termination, or condition.

All determinations under this section, including incident classification, documentation, review outcomes, demerit allocation, suspension periods, termination decisions, reinstatement eligibility, and reintroduction conditions, are final, non-appealable, and made in the sole and absolute discretion of Dog Social Events. Dog Social Events is under no obligation to provide explanations, reasoning, evidence, or appeal processes in connection with any such determination.

Any suspension or termination imposed under this section applies to the Attendee and the associated Human and may be enforced across multiple Events, venues, or Services operated or facilitated by Dog Social Events. Termination or suspension does not entitle the Human to any refund, credit, or compensation.

Dog Social Events may, at its discretion, provide general guidance or information following an incident. Any such communication is provided without obligation, does not constitute advice or training, and does not create any expectation of reinstatement or future participation.

PROPERTY DAMAGE; LOSS; REIMBURSEMENT; RESPONSIBILITY FOR VENUE AND THIRD-PARTY PROPERTY

Each Human acknowledges and agrees that they are solely and fully responsible for any loss of, damage to, or destruction of property arising out of or in connection with their attendance at, or participation in, any Event, whether caused directly or indirectly by the Human or by an Attendee under their care or control.

Without limitation, this responsibility includes damage to or loss of property belonging to Dog Social Events, Venue Partners, venue operators, landlords, licensors, other attendees, third parties, or any other person or entity present at or affected by an Event. Property may include, without limitation, buildings, fencing, turf, landscaping, fixtures, furniture, equipment, signage, utilities, personal belongings, vehicles, or any other real or personal property.

Dog Social Events does not assume responsibility for the safekeeping of any personal property brought to an Event by a Human or Attendee. All personal property is brought to Events at the sole risk of the Human. Dog Social Events is not liable for any loss, theft, damage, or destruction of personal property, whether occurring within Event grounds, venue premises, or surrounding areas.

Where damage, loss, or destruction of property occurs and is reasonably attributable to the conduct of a Human or Attendee, Dog Social Events reserves the right, in its sole and absolute discretion, to require reimbursement for the full cost of repair, replacement, remediation, cleaning, or associated expenses incurred by Dog Social Events or any third party. Such costs may include, without limitation, labour, materials, professional services, administrative costs, and any fees or charges imposed by Venue Partners or authorities.

Prohibited Items. Except where expressly authorised in writing by Dog Social Events, the introduction of personal Attendee property into Event grounds is strictly prohibited. This includes, without limitation, toys, balls, enrichment items, treats, chews, feeding devices, training tools, play equipment, personal enjoyment devices, or any other objects intended for use by or in connection with an Attendee.

Where any prohibited item is identified within Event grounds, Dog Social Events reserves the right, in its sole and absolute discretion, to require the Human to immediately remove the item from the venue premises or Event grounds. Where immediate removal is not practicable or where compliance is not forthcoming, Dog Social Events may require the item to be disposed of. Dog Social Events assumes no responsibility or liability for any loss or disposal of such items.

Failure to comply with this requirement may result in restriction of participation, removal from a zone or Event, termination of the Ticket, or suspension from future Events, without refund.

Dog Social Events may, but is not obligated to, collect reimbursement directly from the Human, offset amounts against any deposits or credits, or pursue recovery through invoicing or other lawful means. Failure to reimburse requested amounts may result in suspension or termination of Tickets, exclusion from future Events, or other enforcement action, without refund.

Nothing in this section limits Dog Social Events’ rights to pursue any additional remedies available at law or in equity.

ASSUMPTION OF RISK; INHERENT RISKS; VOLUNTARY PARTICIPATION

Each Human acknowledges and agrees that attendance at and participation in any Event is voluntary and involves inherent and unavoidable risks, whether known or unknown, foreseeable or unforeseeable, which may result in injury, illness, harm, damage, loss, or death to Attendees, Humans, or third parties.

Humans expressly acknowledge and agree that dogs are animals with natural instincts, including without limitation the propensity to run, jump, chase, mouth, bark, growl, wrestle, react defensively, react unpredictably, and engage in physical interaction with other dogs, people, objects, and environments. Such behaviour may occur without warning and may result in injury or damage despite the exercise of reasonable care by Dog Social Events, Pawfessionals, venue staff, or others.

Inherent risks associated with Events include, without limitation, interactions between Attendees; interactions between Attendees and Humans; off-leash activity; mixed-group dynamics; environmental conditions; surfaces that may be wet, uneven, slippery, or unstable; crowd density; noise; weather; equipment; fencing; water features; venue infrastructure; arrival and departure conditions; and the conduct of other attendees. No amount of care, zoning, observation, rules, or intervention can eliminate all such risks.

Each Human knowingly and voluntarily assumes all risks associated with attendance at and participation in Events on behalf of themselves and the Attendee, including risks arising from the acts or omissions of other attendees, Attendees, venue staff, Venue Partners, third parties, or the Attendee themselves.

Each Human further acknowledges and agrees that Dog Social Events does not guarantee safety, compatibility, supervision, outcomes, or injury-free participation, and that the presence of Pawfessionals, zoning, rules, signage, or intervention protocols does not eliminate inherent risks or transfer responsibility from the Human.

Participation in Events constitutes the Human’s express acknowledgement that they have assessed the risks involved, determined that the Attendee is suitable for participation, and elected to participate notwithstanding such risks. If a Human does not wish to assume such risks, they must not attend or participate in Events.

Nothing in this section is intended to exclude, restrict, or modify any rights or remedies that cannot be excluded under the Australian Consumer Law.

RELEASE OF LIABILITY; WAIVER; INDEMNITY

To the maximum extent permitted by applicable law, each Human, on behalf of themselves and the Attendee, hereby knowingly, voluntarily, irrevocably, and unconditionally releases, waives, discharges, and covenants not to sue Dog Social Events, its related bodies corporate, directors, officers, employees, contractors, Pawfessionals, volunteers, agents, Venue Partners, licensors, landlords, suppliers, sponsors, insurers, and all respective affiliates and representatives (collectively, the “Released Parties”) from any and all claims, demands, actions, causes of action, damages, losses, liabilities, costs, and expenses of any kind or nature whatsoever, whether known or unknown, suspected or unsuspected, arising out of or in connection with attendance at, participation in, attempted participation in, or exclusion from any Event or Service.

This release applies to, without limitation, any claims arising from or relating to: (i) the conduct, behaviour, actions, or omissions of an Attendee or any other attendee; (ii) interactions between Attendees; (iii) interactions between Attendees and Humans; (iv) off-leash activity; (v) zoning decisions or failures to zone; (vi) intervention or non-intervention by Pawfessionals or Dog Social Events; (vii) injuries, illness, death, or property damage; (viii) venue, surface, or environmental conditions; (ix) enforcement actions, sanctions, suspensions, removals, or refusals of entry; and (x) acts or omissions of Venue Partners, third parties, or other attendees.

Each Human expressly acknowledges and agrees that this release includes claims based on alleged negligence, breach of duty, breach of contract, occupier’s liability, statutory duty, or any other legal theory, EVEN IF CAUSED IN WHOLE OR IN PART BY THE ACTS OR OMISSIONS OF ANY RELEASED PARTY, to the fullest extent permitted by law.
